What is a conveyancing solicitor?

A conveyancing solicitor or licensed conveyancer is a qualified professional who will carry out the conveyancing services on your behalf to help you get your move completed.

For customers, conveyancing solicitors and licensed conveyancers are essentially the same thing. Both are fully qualified in property conveyancing and will do exactly the same job.

The only differences are that conveyancing solicitors are regulated under the Solicitors Regulation Authority and they specialise in conveyancing and may be qualified in other legal services. Licensed conveyancers, meanwhile, tend to be specialists in property law and are regulated under the Council for Licensed Conveyancers.


What does a conveyancer do?

The conveyancing services provided by your solicitor will depend on the transaction you have hired them to help with. For example, if you are buying a property, the role of a conveyancer is to:

  • Confirm your ID and ask to see a mortgage offer, if you are buying with a mortgage
  • Request a number of searches to provide information on the property and the surrounding area
  • Agree a completion date
  • Exchange contracts with the sellers
  • Transfer funds on completion day and arrange for the keys to be collected
  • Register you as the new owner with the Land Registry and pay any Stamp Duty Land Tax (in England) or Land Transaction Tax (in Wales) on your behalf

If you are selling a property, the role of a conveyancer is to:

  • Draw up the sale contract and let the buyer know what is included in the sale
  • Confirm with the buyer's conveyancing solicitor that the funds are in place
  • Agree a completion date
  • Agree on the exchange of contracts
  • Pay off any outstanding mortgage once the sale is complete. Your conveyancing solicitor will then deduct their fees and send the remaining funds to you

How much does conveyancing services cost?

The price of your conveyancing services will vary depending on the value of your property and the transaction you are completing, so unfortunately there's no one simple answer to this question.

However, these are some of the charges you may typically expect to find:

  • Solicitors' fees
  • Surveyors' fees
  • Lenders' fees
  • Stamp Duty Land Tax*** (in England, Land Transaction Tax in Wales)
  • Land Registry Fees
  • Local Authority Searches
  • Electronic bank transfer fee
  • Management pack for leasehold properties
  • Estate agent costs
  • Removal costs
  • VAT

The Stamp Duty Land Tax Holiday of up to £500,000 ended on the 30th June 2021. However, there is still temporary relief in place until 31st September 2021 up to £250,000, with the stamp duty rate ranging from 2% to 12% of the purchase price in England and Northern Ireland. After then, stamp duty will revert back to the normal threshold of £125,000.
